Delivery

Our team works hard to dispatch your orders as quickly as possible. Please note delivery time frames begin from when you receive your shipping notification, not from when your order is placed on the ENVIROSIDE INTERNATIONAL website.

*The estimated shipping times above have been supplied by Australia Post and may take longer than expected. We recommend tracking the delivery progress of your parcel via the Australia Post website. If your parcel hasn't arrived within 10 business days of the estimated delivery date, please contact our Customer Service team. 

Please note that during sale or promotional events, delivery may be longer than the specified times above. 

Tracking

As soon as your order is placed, you’ll receive an order confirmation email confirming your order. After your order has been shipped from the warehouse, you’ll receive an email from Australia Post with your tracking number.

You can then track the delivery of your parcel by visiting the Australia Post website and entering your tracking number.

Authority to leave

Please note due to the safety measures that Australia Post has put in place to minimise risk, parcels will no longer require a signature for delivery or collection. Regardless of whether you select Authority to Leave at checkout, your parcel may be left at the door or on your premise by the Australia Post driver.

ENVIROSIDE INTERNATIONAL cannot be held responsible for parcels lost or stolen as a result of these temporary delivery safety measures that have been put in place by Australia Post.

Enviroside International Pty Ltd and its related entities (referred to as ENVIROSIDE INTERNATIONAL, we or our) are committed to the protection of your Personal Information in accordance with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) as amended by the Privacy Amendment (Enhancing Privacy Protection) Act 2012 (Cth) (Privacy Act).

4.2 ENVIROSIDE INTERNATIONAL may also collect Personal Information about you via third parties including from our suppliers and merchants.

5.1 ENVIROSIDE INTERNATIONAL will not collect any Personal Information about users of our Website except when they knowingly provide it or as otherwise described below. For example, ENVIROSIDE INTERNATIONAL may collect Personal Information from users of the Website when they:

5.6 Web beacons are images that originate from a third party site to track visitor activities. ENVIROSIDE INTERNATIONAL may use web beacons to collect aggregate data and provides this information to our Website host to administer and improve the performance of our Website. Advertising

7. Who do we disclose your Personal Information to?

7.1 Depending on the nature of your relationship with ENVIROSIDE INTERNATIONAL, we may disclose your Personal Information to shareholders, officers and employees of ENVIROSIDE INTERNATIONAL, other businesses within our group of companies, service providers who assist us in our business operations, parties involved in the purchase or sale of any of our businesses, other third parties, or otherwise as required by law.

7.2 ENVIROSIDE INTERNATIONAL may also disclose your Personal Information to our Website host or service providers in certain limited circumstances, for example when our Website experiences a technical problem or to ensure that it operates in an effective and secure manner. 8.3 Personal Information that is held by ENVIROSIDE INTERNATIONAL in hard copy is stored securely and is only disclosed or used for the purposes described in this Privacy Policy.

We will take reasonable steps to ensure that the Personal Information that we hold is accurate, up-to-date and complete. You can update your Personal Information at any time by contacting ENVIROSIDE INTERNATIONAL in any of the ways specified in clause 13. ENVIROSIDE INTERNATIONAL welcomes any changes to your Personal Information so as to keep our records up to date.

10.3 If you wish to have your Personal Information destroyed or de-identified, please let us know and we will take reasonable steps to do so (unless we need to keep it for legal, auditing or internal risk management reasons).

11. Finding out what Personal Information ENVIROSIDE INTERNATIONAL holds about you

11.1 You are entitled to access Personal Information that ENVIROSIDE INTERNATIONAL holds about you. If you request access to your Personal Information, we will grant your request unless providing you with access would unreasonably impact upon the privacy of others or is not otherwise permitted under the Australian Privacy Principles or at law. If we refuse your request to access your Personal Information, we will provide you with written reasons for the refusal.

Refund Policy

Returns

We want you to be happy with your purchase, however, if you are not completely satisfied you can return your item(s) to us for a refund within the following timeframes:

Online: 30 days from the date of receipt

We’re able to accept your item(s) for a refund based on the following conditions:

Proof of purchase is accompanied with the returned merchandise;

The item(s) is/are unused, and in its original condition with original packaging intact. 

Returns by Post

Return your online purchase by post free of charge for a limited time. This applies to online orders delivered to an Australian address only. Steps to return your item(s):

Send an email to admin@envirosideinternational.com with your full name, order number.  You’ll then receive a reply-paid label from us.

Fill in the Returns Form you received in your original parcels and place this inside the parcel with the item(s) to be returned.

Ensure the return parcel is securely packaged and both the sender’s address and the ENVIROSIDE INTERNATIONAL online return address is clearly visible on the outside of the parcel.

We currently cannot offer exchanges for online orders returned to the Online Warehouse. 

Important Information:

Based on current processing times, it may take up to three weeks for returns to be processed from the day the parcel is received at our warehouse. 

Ensure the return parcel is securely packaged. To avoid delays in delivery, we encourage you to use Registered Post so the items can be tracked. ENVIROSIDE INTERNATIONAL is not liable for the loss of an item that is in transit to our online warehouse.

Faulty, Damaged or Incorrect Items

If you believe you’ve received faulty, damaged or incorrect items, please email admin@envirosideinternational.com with the details and photos if these are available. Upon inspection of the photos, we’ll send you a reply paid returns label for the merchandise to be returned to us if there’s a genuine manufacturing fault or if a dispatch error has occurred. If you require more information about this process, please contact our Customer Service team.

WEBSITE TERMS AND CONDITIONS (TERMS)

In these Terms, "we" and "us" mean ENVIROSIDE INTERNATIONAL Pty Ltd (ENVIROSIDE INTERNATIONAL) and "you" means you the customer or site visitor. Access to and use of the Website and the products and services available through the Website are subject to the following Terms as may be updated by us from time to time.

1. Your acceptance

2. Orders for goods through the Online Store

The purchase of goods or services from ENVIROSIDE INTERNATIONAL via the Online Store is governed by these Terms and any relevant terms of third party websites that are involved in the sale of the goods or services (including privacy policies).

ENVIROSIDE INTERNATIONAL provides its Website visitors and members the opportunity to purchase goods from ENVIROSIDE INTERNATIONAL. By placing an Order to purchase goods via the Online Store, you are offering to purchase a product on and subject to these Terms. All Orders are subject to availability and confirmation of the order price.

To place an Order with ENVIROSIDE INTERNATIONAL you must be over 18 years of age and have a registered PayPal account, valid credit card or debit card issued by a bank or credit union acceptable to us.

By placing an Order via the Online Store you are making an offer and commitment to purchase the goods on these Terms. An Order is subject to acceptance or rejection by ENVIROSIDE INTERNATIONAL in its discretion after receipt of the Order in Australia. Once you have placed an Order and the applicable payment is received by us, the Order cannot be cancelled by you.

Once you have placed an Order, we will send you an acknowledgement email confirming receipt of your Order. This email will only be an acknowledgement and will not constitute acceptance of your Order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card, nominated bank account or PayPal account.

We will send you a second email confirming the Order once full payment for the Order has been received by ENVIROSIDE INTERNATIONAL and the Order has been dispatched. Once this has occurred, the sale contract has concluded and the title in the goods passes to you as well as any risk of loss or damage.

3. Pricing and availability

All prices are shown and transactions are processed in Australian Dollars (AUD). Prices are inclusive of goods and services tax. In all other respects, the price is exclusive of taxes, duties and charges imposed or levied in Australia or overseas in connection with the supply of goods or services.

You should note that some countries have import restrictions on certain goods or services. If you are outside Australia, you will be responsible for checking whether such restrictions apply before placing an Order. If you are outside Australia you will become the importer and may be liable to pay local taxes or duties, and you will assume all liability under any customs or import laws and regulations.

Whilst we try to ensure that all details, descriptions and prices that appear on the Website and Online Store are accurate, errors may occur. If there is a pricing error in any of the goods you have ordered we will notify you as soon as possible. You will have the option to proceed with your Order at the correct price or cancel your Order. The Order will be automatically cancelled if we are unable to contact you. If you cancel your Order and you have already paid for the goods, we will provide you with a full refund.

ENVIROSIDE INTERNATIONAL reserves the right to change the prices of goods in our Online Store from time to time as required. We reserve the right to change pricing and other information immediately without notice to you in the event of any errors. We also reserve the right to refuse to complete any Orders based on information on our Website or Online Store that is outdated or otherwise incorrect.

4. Discount codes

ENVIROSIDE INTERNATIONAL may offer discount codes to be used in the Online Store in relation to some promotions. The conditions of a discount code will be specified at the time of issue. Discount codes are not redeemable in-store.

5. Credit card fraud

ENVIROSIDE INTERNATIONAL employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with customers. However, in addition to our rights under these Terms we will not be responsible for any damages, or consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

6. Returns and refunds of an order

If you are not satisfied with the quality of the goods or services you have purchased or you change your mind, you may contact ENVIROSIDE INTERNATIONAL using the details provided in the Order. Any refund or return will be at ENVIROSIDE INTERNATIONAL's discretion and in accordance with our Returns Policy and applicable laws.

7. Colours

Please note that colours of products will sometimes vary depending on the quality and make of the device or monitor they are being viewed on.

8. Deliveries

Delivery and shipping of goods will be in accordance with our Shipping Policy.

9. Content

ENVIROSIDE INTERNATIONAL has the right, but not the obligation, to monitor any information, comment, content, communication, advice, text, or other material (Content) made available on the Website. ENVIROSIDE INTERNATIONAL reserves the right, in its absolute discretion, to block, modify or remove any Content contained on the Website without notice, and will not be liable in any way for possible consequences of such actions.

Furthermore, ENVIROSIDE INTERNATIONAL does not warrant or make any representations as to any third-party products or services described or referred to on the Website. 11. Online Sale Events

From time to time ENVIROSIDE INTERNATIONAL will run online-only sale events. These online-only sales are valid on the website only and is not applicable or available in-store. This online sale event is strictly limited to selected marked items only on https://www.binkill.com.au

Limited styles, stock and sizing applies and some items may sell out before the end of the sale.

Subject to the consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law), ENVIROSIDE INTERNATIONAL does not warrant that you will have continuous access to the Website. ENVIROSIDE INTERNATIONAL will not be liable in the event that the Website is unavailable to you due to computer downtime attributable to malfunctions, upgrades, preventative or remedial maintenance activities or interruption in telecommunications supply.

ENVIROSIDE INTERNATIONAL does not guarantee the delivery of communications over the internet as such communications rely on third-party service providers. 20. Jurisdiction and law

These Terms are governed by and must be construed in accordance with the laws of the State of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of that State and the Commonwealth of Australia in respect of all matters arising out of or relating to these Terms, their performance and subject matter.

21. Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms.

22. Severability

Each provision of these Terms is severable from the others and no severance of a provision will affect any other provision.

23. Entire Agreement

The above Terms constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and ENVIROSIDE INTERNATIONAL. Any waiver of any provision of the Terms will be effective only if in writing and signed by a Director of ENVIROSIDE INTERNATIONAL.

If an offer has expired, the customer cannot receive an extension. An Offer or Promotion is not redeemable for cash or against any prior purchases.

CREDIT REPORTING POLICY

This Credit Reporting Policy relates to ENVIROSIDE INTERNATIONAL Pty Ltd and to our related entities (referred to as (ENVIROSIDE INTERNATIONAL), we, us or our) that are deemed to be a credit provider for the purposes of the Privacy Act 1988 (Cth) (Privacy Act).

1. About this Credit Reporting Policy

1.1 We may provide credit to our customers in connection with our products and services and, as a result, we may collect credit information and credit eligibility information about you. This Credit Reporting Policy relates to ENVIROSIDE INTERNATIONAL and our related entities that are deemed to be credit providers for the purposes of the Privacy Act.

1.2 This Credit Reporting Policy governs the manner in which we manage, collect, hold and use credit information and credit eligibility information where this relates to you and is our Credit Reporting Policy for the purposes of Part IIIA of the Privacy Act. We may, from time to time, review and update this Credit Reporting Policy including to take into account new laws, regulations and technology. If we do update this policy it will be posted on our website at www.binkill.com.au.

1.3 Our Privacy Policy describes the manner in which we collect, hold and use Personal Information and other information that is covered by the Privacy Act. The information held by us that is covered by the Privacy Act will be governed by this Credit Reporting Policy together with our most recent Privacy Policy, posted on our website at www.binkill.com.au.

2. What information is covered by this Credit Reporting Policy?

2.1 Not all information is protected information under the Privacy Act. The Privacy Act protects Personal Information, Sensitive Information and certain types of credit-related information. What is Personal Information or Sensitive Information?

2.2 “Personal Information” is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not, and whether recorded in a material form or not.

2.3 “Sensitive Information” is Personal Information about an individual that includes health information, genetic information, biometric information or templates, or personal information that is also information or an opinion about an individual's race or ethnicity, their religious, political or philosophical beliefs, opinions or affiliations, their sexual orientation or criminal record. What is credit information or credit eligibility information?

2.4 Credit information is information about you that relates to your credit-related dealings with us. The Privacy Act sets out the various types of information that can be collected by us when we act as a credit provider as well as the various types of information that can be collected by or disclosed by credit reporting bodies.

2.5 “Credit Information” is Personal Information about an individual other than Sensitive Information that may include:

(a) identification information about the individual;
(b) certain information about the individual relating to a consumer credit account (including eligibility information, repayment history, payment information and default or serious credit infringement-related information);

(c) information requests made about the individual to a credit reporting body in connection with an application for consumer credit or commercial credit, or for a credit guarantee purpose;

(d) various publicly available information such as personal insolvency or bankruptcy information or credit-related court judgments; or

(e) information about the individual relating to an application for consumer credit or commercial credit or relating to the individual’s credit worthiness.

2.6 “Credit eligibility information” is Personal Information about an individual other than Sensitive Information that includes the kinds of credit information listed above where that information:

(a) is disclosed to us by a credit reporting body and includes credit reporting information about the individual such as information relating to credit worthiness;

(b) relates to your dealings with other credit providers that may provide you with credit; or

(c) includes credit worthiness information that we derive from information disclosed to us by credit reporting bodies or that we collected from other credit providers where you have expressly consented to that disclosure.

2.7 We may also collect and hold Personal Information about an individual other than Sensitive Information that we derive from credit reporting information obtained from a credit reporting body that deals with that individual’s credit worthiness and that may be used in establishing that individual’s eligibility for consumer credit.

What types of information do we collect and hold?

2.8 We may collect and hold credit information such as your identification information (including your name, date of birth or gender), contact details (including your address, phone numbers and emails, whether personal or for work), financial information, payment details, bank account details, tax file number, drivers’ licence information, employment information, products and services information and/or information about your preferences and orders.

2.9 We may collect and hold credit eligibility information about you such as information relating to your credit worthiness, including trade references, credit reports and payment history information.

3. How do we collect and hold your credit information or credit eligibility information?

3.1 We may collect credit information or credit eligibility information about you in any of the ways that we collect Personal Information about you as set out in our Privacy Policy under the heading ‘When and how do we collect Personal Information’.

3.2 We will take reasonable steps to protect credit information or credit eligibility information we hold about you from misuse, interference and loss and from unauthorised access, modification or disclosure.

4. Why we collect, hold, use and disclose credit information and credit eligibility information about you?

Purposes for which we may use credit information4.1 We will only collect, hold, use and disclose credit information and credit eligibility information about you for purposes permitted under the Privacy Act and the Privacy (Credit Reporting) Code 2014 (Credit Code), including:

(a) to process and assess your application for consumer credit or commercial credit;
(b) to manage your consumer credit or commercial credit account and to collect amounts due under those accounts;
(c) for a credit guarantee purpose;
(d) to assist you to avoid defaults;
(e) to assign our debts;
(f) to enable us to deal with complaints relating to credit or credit reporting; or
(g) to comply with regulatory or other legal requirements or as authorised by law.When do we disclose your credit information and credit eligibility information?

4.2 We may disclose your credit information or credit eligibility information as follows:

(a) to our related bodies corporate;

(b) in order to process your application for credit;

(c) in order to manage the credit we provide to you;

(d) when we believe on reasonable grounds that you have committed a serious credit infringement;

(e) when we are responding to a complaint or we need to deal with an external dispute resolution scheme; or

(f) to other credit providers when you have consented to that disclosure.

4.3 We may disclose your credit information or credit eligibility information outside of Australia to an entity based in a foreign country, including our service providers or entities in which we have an ownership interest.

4.4 These countries currently include Vietnam and the United Kingdom. It is possible that the overseas entities may be subject to foreign laws that do not provide the same level of protection of information as in Australia. We take reasonable steps to ensure that these overseas entities do not breach the APPs and that they are obliged to protect the privacy and security of that information and use it only for the purpose for which it is disclosed.

5. How you may access or correct your credit eligibility information?

Access to your credit eligibility information

5.1 You are entitled to access credit eligibility information that we hold about you. If you request access to your credit eligibility information, we will take reasonable steps to provide you with access within 30 days of your request unless providing you with access would be unlawful or is not otherwise permitted under the Privacy Act or at law.

5.2 Before providing you with access we may request evidence of your identity. We may charge you a reasonable administrative fee for providing access to your credit eligibility information. If we refuse your request to access your credit eligibility information, we will provide you with written reasons for the refusal.

5.3 To make a request for access, contact us in any of the ways specified in section 0. Correction of your credit information or credit eligibility information

5.4 We will take reasonable steps to ensure that credit information or credit eligibility information that we hold about you is accurate, up-to-date and complete. You may request that we correct or update your credit information. We will take reasonable steps to correct your information within 30 days of our request. We will provide you with a notice in writing confirming that we have corrected your information or provide you with reasons if the correction has not been made.

5.5 To make a correction, contact us in any of the ways specified in section 0.

6. How to contact us or make a complaint?

6.1 If you feel that we have not complied with our obligations under Part IIIA of the Privacy Act or with the Credit Code, or for any other queries, problems, complaints or communication in relation to this Credit Reporting Policy, please contact us in any of the ways set out below.

6.2 We will acknowledge your complaint within 7 days of the complaint being made and we will investigate your complaint. We will take reasonable steps to investigate, resolve and make a decision about your complaint. We may need to consult with a credit reporting body or another credit provider about your complaint.

6.3 We will give you a written notice of the outcome within 30 days of the complaint being made unless we are unable to resolve your complaint within this time period. We will notify you if we are unable to resolve your complaint within 30 days and we will set out in writing the reasons for the delay and the expected timeframe to resolve the complaint. We will provide you with a decision in writing about your complaint.

6.4 If you are not satisfied with the outcome of your complaint you may make a complaint to the Australian Information Commissioner. The Information Commissioner may be contacted at www.oaic.gov.au or by email at enquiries@oaic.gov.au.
